Notwithstanding any provision of P.L.1985, c. 334 (C.58:11B-1 et seq.) or P.L.1997, c. 224 (C.58:11B-10.1 et al.) to the contrary, the trust may receive or access emergency or relief federal funds that are appropriated to the State subsequent to a federal or State declaration of emergency to make loans or grants in the implementation of the New Jersey Environmental Infrastructure Financing Program , the New Jersey Transportation Infrastructure Financing Program, or the Community Hazard Assistance Mitigation Program established pursuant to sections 1 through 8 of P.L.2023, c. 63 (C.58:11B-20.3 et al.), to local government units, public water utilities or private persons for any wastewater treatment system projects included on the clean water project priority list for the ensuing fiscal year and eligible for approval pursuant to section 20 of P.L.1985, c. 334 (C.58:11B-20), water supply projects included on the drinking water project priority list for the ensuing fiscal year and eligible for approval pursuant to section 24 of P.L.1997, c. 224 (C.58:11B-20.1), transportation projects included on the transportation project priority list for the ensuing fiscal year and eligible for approval pursuant to section 36 of P.L.2016, c. 56 (C.58:11B-20.2), or hazard mitigation and resilience projects included on the Community Hazard Assistance Mitigation Program Project Eligibility List for the ensuing fiscal year and eligible for approval pursuant to sections 1 through 8 of P.L.2023, c. 63 (C.58:11B-20.3 et al.), as applicable, or to make non-project related loans and provide other assistance, including CAP payments and other financial assistance on behalf of or as a conduit for local government units, in accordance with the ranking criteria determined by the federal or State government.
For the purposes of this section, “CAP Payment” means a payment made by a project sponsor pursuant to a State or federal relief program for utility customers or a consumer assistance program.
