Any person who has owned or operated an underground storage tank as defined pursuant to section 2 of P.L.1986, c. 102 (C.58:10A-22) who has not registered that tank pursuant to the provisions of P.L.1986, c. 102 (C.58:10A-21 et seq.), shall not be subject to a civil penalty for the failure to register that underground storage tank if the person, within one year of the effective date of this act, registers the tank pursuant to P.L.1986, c. 102. The department may require that person to pay any registration fees that would have been paid had the underground storage tank been registered in accordance with law.
