New Jersey Statutes Title 48. Public Utilities 48 § 12-92.1

Any railroad utility meeting the requirements of section 48:12-91 and after obtaining the consent and approval required by said section, may exercise the power of eminent domain as provided in sections 48 and 49 hereof  1 in acquiring real estate and personal property necessary and useful for the purposes of 48:12-91.
