Any communication between a person licensed as a professional or an associate creative arts therapist and the person receiving the creative arts therapy shall be confidential and its privacy preserved. This privilege shall not be subject to waiver without patient or client consent, except when disclosure is required by State or federal law or when the person licensed as a professional or an associate creative arts therapist is a party defendant to a civil, criminal or disciplinary action arising from that creative arts therapy, as the case may be, in which case the waiver of the privilege accorded by this section shall be limited to that action. In addition, this privilege shall be subject to waiver if the licensee has information that the client presents a clear and present danger to the health or safety of the client or others.
