The owner or lessee of a motor vehicle that is subject to inspection pursuant to R.S. 39:8-1 and that is included in either a “Voluntary Emissions Recall” as defined at 40 C.F.R. s.85.1902(d) or any amendment thereto or in a remedial plan determination made pursuant to section 207(c) of the federal Clean Air Act 1 or any amendment thereto, for which owner notification occurs after the effective date of P.L.1995, c. 112 (C.39:8-41 et al.), shall obtain the required repairs within the time period established by the director, in consultation with the Department of Environmental Protection, in order to obtain a certificate of approval. The director shall allow the owner or lessee of a motor vehicle which is subject to recall a minimum of 60 days in which to comply with such recall notice. It shall be the responsibility of the owner and lessee of a vehicle to submit proof of required repairs in response to such recall notice in a form and manner determined by the director. The director shall suspend the registration privileges or deny an application for registration for any vehicle that has failed to receive necessary repairs in response to a “Voluntary Emissions Recall” or to a remedial plan determination within the time period established by the director in consultation with the Department of Environmental Protection.
