An individual who brings an action against a carrier or organized delivery system pursuant to subsection a. of section 4 of this act shall be required to exhaust an appeal through the Independent Health Care Appeals Program created pursuant to section 11 of P.L.1997, c. 192 (C.26:2S-11) before filing an action, unless serious or significant harm to the covered person has occurred or will imminently occur.
