Nothing contained in paragraph e. of the definition of an eligible person as set forth in section 25 1 of this 1990 amendatory and supplementary act shall be deemed to permit an insurer subject to the provisions of that paragraph e. to refuse coverage to a person pursuant to the provisions of section 27 2 or section 39 3 of this act unless that insurer has complied with its depopulation obligation, as determined by the commissioner pursuant to the provisions of section 26 of P.L.1983, c. 65 (C.17:30E-14) and paragraph (5) of subsection c. of section 88 of this act, by October 1, 1992.
