There is created in the Department of Environmental Protection and Energy a special nonlapsing fund to be known as the “Toxic Packaging Reduction Fund.” The fund shall be administered by the department and shall be the depository for all fees collected pursuant to section 7 of this act, 1 and all assessments and penalties received pursuant to section 11 of this act, 2 and any interest earned thereon. Unless otherwise specifically provided by law, monies in the fund shall be utilized exclusively by the department to administer and enforce the provisions of this act, or any rule or regulation adopted pursuant thereto.
