1. It shall be lawful for the town council or other governing body of any town in this state, in which any such arrearages of taxes, assessments or water rates may exist, to make application to the circuit court of the county in which such town is situate, for the appointment of three freeholders and residents of this state as commissioners of adjustment, at least one of whom shall be a resident of the town, for the purpose of performing the duties and executing the powers conferred by the following sections of this act; at least two weeks' notice of such intended application shall be given by public advertisement, signed by the town clerk of the town and published at least once each week in two newspapers published in the county in which the town is situated and circulating in such town; such notice shall state the time and place, when and where said application is intended to be made, and all persons interested therein, either as taxpayers, owners of delinquent lands or otherwise, shall be entitled to appear and be heard before the court on said application; after such hearing, and upon due proof that notice has been given as aforesaid, on which the judgment of the court shall be final and conclusive, it shall be the duty of the court to appoint three disinterested freeholders and residents as aforesaid as commissioners of adjustment for said town for the purposes aforesaid; said commissioners of adjustment shall, before entering upon the discharge of their duties, take and file with the town clerk the oath of office required to be taken by officers of the town for which they are appointed, and they shall receive for their services such compensation, to be paid by the town, as the said court shall determine; vacancies in the board of commissioners, caused by death or otherwise, shall be filled by appointment by the circuit court of the county in which such town is situated.
