1. That it shall be the duty of each and every person engaged in the business of surveying lands in the counties of Salem and Cumberland, in this state, to test and note the actual variation of his compass from the true meridian line standard of his county, at least twice in every year, which shall be in the months of April and October, and to deposit a certificate of the same under his hand, with the date and time of such test, with an affidavit verifying its correctness with the clerk of the county in which he may reside, to be by him recorded in a book provided for that purpose, which certificate shall be in the following or like form: “On the ․․․․․․ day of ․․․․․․․․․․․․ anno Domini, ․․․․․․․․․․․․, I, A B, a practical land surveyor of the county of ․․․․․․․․․․․․, did test and note the actual variation of my compass from the true meridian line standard of said county, and find that the north end of the needle points ․․․․․․․․․․ degrees and ․․․․․․․․․․ minutes to the west of said meridian line standard, signed A B”; and every surveyor neglecting or refusing to comply with the provisions of this or any other section of this act shall be liable to a penalty of fifty dollars, to be sued for and recovered with costs in an action of debt before any justice of the peace, by and in the name of the clerk of such county, or by any other person, for the use and benefit of such county, to be applied on recovery to such county uses as the board of chosen freeholders of the county where the same is recovered shall direct.
