1. That it shall and may be lawful for the common council, board of aldermen or other governing body of any city or municipality of this state, at present without a paid fire department, to provide by general ordinance for the creation and maintenance of a paid fire department for such city or municipality, and also for the appointment by the mayor of such city or municipality, by and with the consent of the common council, board of aldermen or other governing body therein, of four citizens of such city or municipality, who shall hold office for the period of three years from the date of their appointment, and, who shall serve without salary or compensation, who, with the said mayor, shall constitute a board of fire commissioners of said city or municipality, the powers and duties of which board shall be prescribed and regulated by the said ordinance.
