2. That the said commissioners, before they enter upon the duties imposed upon them, by this act, shall take and subscribe an oath or affirmation, before some judge or notary public, that they will faithfully and impartially perform such duties; if any of such commissioners shall die, refuse to act, or resign, the vacancy shall be filled by the appointment, by a justice of the supreme court, of another chosen freeholder from the county from which the vacancy occurred; the said commissioners shall choose one of their number to be president, and shall appoint some competent person, not of their own number, to be clerk; and any notice signed by the said president and clerk shall be as valid and effectual as if signed by all or a majority of said commissioners.
