2. Such contract between said commission and the state of New York, or such properly constituted agency or authority thereof as aforesaid, or with any contractor or contractors for the construction of such tunnel or tunnels whereby the state of New Jersey agrees to pay a share or a part of the cost thereof, shall contain a stipulation that it is expressly understood and agreed by and between the respective parties thereto that such contract shall bind the state of New Jersey only to the extent of moneys available therefor, and that no liability on account of such contract shall be incurred beyond the amount of moneys available for the purposes specified therein. And such contract between this state and the state of New York, or such properly constituted agency or authority thereof, as aforesaid, may contain a provision that the same is executory only and binding on the state of New York only to the extent of moneys made available therefor by the state of New York, and that no liability is incurred by the state of New York beyond the moneys so made available. No contract or agreement with any contractor or contractors for the construction of such tunnel or tunnels, or for any work in connection therewith, exceeding in amount the sum of one thousand dollars, shall be made without advertisement for bids, for such time and in such manner as shall be determined upon. Upon the proper certification of said commission, the comptroller shall issue his warrant, and the state treasurer upon such warrant shall pay from the moneys available for the purpose, as in such certification or approved voucher is directed.
