2. The governor of the state shall, upon the making of such appropriation, appoint a commission, to consist of three persons, citizens of this state, to select a design, to contract for, erect and finish a suitable monument or statute [statue] on a site to be selected by said commission, and also to grade the grounds immediately surrounding said monument on the said battlefield of Red Bank; said commissioners shall receive no compensation for their services, and the governor shall fill all vacancies that may occur by death, resignation or otherwise.
