1. The governor be and he is hereby authorized to appoint a commission to consist of three persons, residents of the state of New Jersey, for the purpose of acquiring, on behalf and in the name of the state of New Jersey, a plot of ground in the borough of Riverside, in the county of Bergen, this state, on which the building known as the Old Steuben Home is located. Said commission, when appointed, shall have power to acquire said property by gift, devise, purchase or by condemnation, according to the procedure as contained in an act entitled “An act to regulate the ascertainment and payment for property condemned or taken for public use” (Revision of 1900), approved March twentieth, one thousand nine hundred, and vacate the said plot of ground. The said commission shall have the right and power to enter upon and take the said plot of ground in advance of making compensation therefor if it cannot acquire said plot of ground by agreement with the owner, whether by reason of disagreement as to the price, or the legal incapacity or absence of the owner, or his inability to convey valid title, or by reason of any other cause. In any such case, upon the said commission exercising this right and entering upon and taking land in advance of making compensation therefor, it shall present a petition, and proceedings shall be had to fix the compensation to be paid to the owner, as provided in the said act entitled “An act to regulate the ascertainment and payment of compensation for property condemned or taken for public use” (Revision of 1900), approved March twentieth, one thousand nine hundred. The powers are to be liberally construed.
