5. That all openings of the surface of the public road for the purpose of making house connections, sewer connections and service connections for water and gas and all connections before referred to, shall in every instance be made only after permission obtained therefor from the board of chosen freeholders of said county, and shall be made subject to such regulations and conditions as such board shall prescribe, and not otherwise, and in making all such regulations and connections, provision is hereby authorized to be made for the making and keeping in proper and safe condition and repair for any time not exceeding one year after the same shall have been made and restored, all such openings as aforesaid of the surface of said public road, and said board is authorized hereby to require a deposit by certified check or in cash to be made with the county collector or treasurer of said county for or in such sum as the said board of chosen freeholders shall by resolution designate or order, to insure or guarantee that the surface of the said public road will be restored to and kept in good condition as aforesaid, and if said surface is not restored to such good condition, after ten days' notice in writing to that effect shall have been given by or on behalf of such board, or by the said engineer or officer in charge of said road to the person or party doing or permitted to do the work, the said board of chosen freeholders may do or cause the work necessary to be done to restore said surface to such good condition, and may devote or apply as much of the said deposit as may be necessary to pay for the same, to that object, and upon the completion of said work the whole or the remainder of said deposit, if any, shall be returned to the party who may have made the same as aforesaid.
