3. That in acquiring the right of way for the public road provided for in the act to which this is a supplement, and the roads provided for by this supplement, in case it shall be necessary to cross over any property either upon, above or below the surface thereof, and the said board of chosen freeholders shall deem it desirable so to do, it shall be lawful for said board to make such crossings under a contract to be entered into between said board and the owner or owners of said lands upon such terms as shall be agreed upon between the said board and the owner or owners of said lands; provided, that no such contract shall be entered into which shall require the payment by the said board of chosen freeholders of any money to said landowner or landowners.
