10. The moneys in the state highway fund shall be used by the state highway commission
only for the constructing, improving, reconstructing and rebuilding of the state highway
system, as authorized by law, at the time this act becomes operative, and said moneys
are to be controlled and disbursed only for the aforesaid purposes; provided, however,
that said moneys realized under this act, or so much thereof as shall be necessary,
shall first be devoted to the building of bridges, tunnels and viaducts and the acquisition
of rights of way.
