2. That such part or parts of the act and supplements to which this is a further supplement, as come within the purview of this act and are contrary to the provisions thereof, and all other acts and parts of acts inconsistent with this act, be and the same are hereby repealed; provided, always, that this act shall not be so construed as to in any way change or affect the charter or rights of any private or public corporation aiming at the same results heretofore granted by the legislature of this state, or to apply to any streams which have been declared by an act of the legislature a public highway.
