(1) A person may not begin construction of a high-hazard dam as determined under 85-15-209 without first obtaining a construction permit from the department.
(2) An application for a construction permit must be submitted to the department and must contain:
(a) plans and specifications for the proposed construction, prepared by or under the direction of an engineer experienced in dam design and construction; and
(b) other data and information required by the department.
(3) Within 60 calendar days after receipt of the application and any additional information requested by the department, the department shall:
(a) issue a construction permit or deny the application, as filed; or
(b) issue a construction permit upon terms, conditions, or modifications the department considers appropriate.
