(1) A person who has been damaged by reason of a violation of 80-20-103 may bring against the person who caused the damage an action in the district court to recover actual and consequential damages and court costs and reasonable attorney fees.
(2) This part may not be construed to affect any other rights of a person who has been damaged by reason of a violation of this part. The provisions of subsection (1) may not be construed to limit the exercise of any rights arising out of or relating to a violation of 80-20-103.
