The director of the department shall take action that the director considers appropriate, consistent with federal jurisdiction, to address concerns and issues raised during the hearing. The action may include but is not limited to:
(1) the filing of formal requests for action by the appropriate federal agency that would alleviate concerns expressed at the hearing;
(2) the filing of a formal protest to the proposed sale or transfer.
