The insured's right of individual privacy requires agencies and agency personnel receiving information furnished pursuant to 50-63-401 and 50-63-402 to hold the information in confidence unless:
(1) the insured waives the right of individual privacy; or
(2) release of the information is required pursuant to a criminal or civil proceeding.
