(1) Except in a medical emergency, a person may not purposely or knowingly perform, induce, or attempt to perform or induce a dismemberment abortion procedure.
(2) A person who violates this section is guilty of a felony and on conviction shall be punished by a fine in an amount not to exceed $50,000, imprisonment for a term of not less than 5 years and not more than 10 years, or both.
(3) A woman on whom an abortion is performed, induced, or attempted in violation of this part may not be prosecuted for conspiracy to commit a violation of this part.
