(1) The department may, at its discretion or upon written complaint of an aggrieved person, investigate an alleged violation of this chapter by a licensee or applicant for licensure. If the investigation discloses a probable violation of this chapter or department rules, the department may institute a proceeding pursuant to the provisions of 37-1-403.
(2) A licensee or license applicant may be sanctioned as provided in 37-1-406 for unprofessional conduct defined in 37-1-410 or department administrative rules.
