Montana Title 33. Insurance and Insurance Companies § 33-17-232. Rights of insurance producer following termination of appointment

(1) Following termination of an agency appointment for property, casualty, title, or surety insurance and subject to the terms of an agreement between the insurance producer and the insurer, the insurance producer may continue to service and receive from the insurer commissions or other compensation relative to business written by the insurance producer for the insurer during the existence of the appointment.

(2) This section does not apply to:

(a) insurance producers of direct writing insurers;  or

(b) insurance producers or insurers between whom the relationship of employer and employee exists.
