Any party to the proceeding in partition claiming such moneys as owner of the premises sold may file his petition in the office of the clerk of the court, setting forth the nature of his claim in all its particulars, and the name and residence, if known, of the other party claiming as aforesaid, and praying an order for the payment of the money to him; which petition shall be verified by the affidavit of the petitioner or some credible person.
