Whenever in the opinion of the commissioners, in any case of partition or order of sale, it will be to the interest of the parties to divide the lands into lots, and lay out streets, avenues, lanes and alleys, they may cause the same to be done, and in that case shall return with their report a plat of the land so laid out, which report shall be subject to the rejection or confirmation of the court, as in other cases.
