If any patient or resident dies, is released, escapes, or otherwise leaves the care of the department, and leaves any article or articles of tangible personal property in the custody of a department facility, the head of the facility may, in his discretion, after the lapse of one year from the date of such death, release, escape, or other departure, if no claim therefor has been made, transfer the personal property to the state agency for surplus property for public or private sale. If such sale or sales are made, the commissioner of administration shall transmit the net proceeds thereof to the director of revenue for deposit in the general revenue fund.
