Minnesota Statutes Trade Regulations, Consumer Protection (Ch. 324-341) § 327B.12. Additional remedies and enforcement

Subdivision 1. Private remedies. (a) Any person injured or threatened with injury by a dealer or manufacturer's violation ofsections 327B.01to327B.12may bring a private action in any court of competent jurisdiction.

(b) A borrower injured by a violation of the standards, duties, prohibitions, or requirements ofsections 327B.08, subdivision 6; 327B.09, subdivision 6; or327B.095, shall have a private right of action and the court shall award actual, incidental, and consequential damages.

Subd. 2. Fraud remedies. In addition to the remedies provided insections 327B.01to327B.12, any violation ofsection 327B.08or327B.09is a violation ofsection 325F.69, subdivision 1and the provisions ofsection 8.31shall apply. A private right of action by the borrower under this chapter is in the public interest.
