(a) The following data that the Department of Natural Resources collects, receives, or maintains through voluntary responses to questionnaires or surveys by forest industry businesses are classified as private data on individuals, as defined insection 13.02, subdivision 12, if the data are data on individuals or as nonpublic data, as defined insection 13.02, subdivision 9, if the data are data not on individuals:
(1) timber resource consumption;
(2) origin of timber resources;
(3) cost of delivered timber;
(4) forest industry product output; and
(5) production costs.
(b) Data that the department collects, receives, or maintains through voluntary responses to questionnaires or surveys by forest industry businesses and that are not specified under paragraph (a), clauses (1) to (5), are public data.
(c) Summary data, as defined insection 13.02, subdivision 19, that the department compiles from data under paragraph (a) or (b) are public data.
(d) Data collected, received, or maintained by the department from bidders on state timber undersection 90.145are not subject to this section.
