If a private employer fails or refuses to comply withsections 3.082and3.083, the district court where the private employer maintains a place of business may, upon the filing of a complaint by the member entitled to the benefits ofsections 3.082and3.083, specifically require the employer to comply with their provisions and compensate the member for any loss of wages or benefits suffered by reason of the employer's unlawful action. The court shall order a speedy hearing in the case and advance it on the calendar.
