Subdivision 1. Creation. A family and medical benefit insurance program is created to be administered by the commissioner according to the terms of this chapter.
Subd. 2. Creation of division. A Family and Medical Benefit Insurance Division is created within the department under the authority of the commissioner. The commissioner shall appoint a director of the division. The division shall administer and operate the benefit program under this chapter.
Subd. 3. Rulemaking. The commissioner shall adopt rules to implement the provisions of this chapter. For the purposes of this chapter, the commissioner may use the expedited rulemaking process undersection 14.389.
Subd. 4. Account creation; appropriation. The family and medical benefit insurance account is created in the special revenue fund in the state treasury. Unless otherwise appropriated, money in this account is appropriated to the commissioner to pay benefits under and to administer this chapter, including outreach required undersection 268B.18. Appropriations and transfers to the account are credited to the account. Earnings, such as interest, dividends, and any other earnings arising from assets of the account, are credited to the account. Money remaining in the account at the end of a fiscal year is not canceled to the general fund but remains in the account until expended.
Subd. 5. Information technology services and equipment. The department is exempt from the provisions ofsection 16E.016for the purposes of this chapter.
Subd. 6. Procurement. For purposes of administering this chapter, until July 1, 2026, the department is exempt from the requirements ofsections 16A.15, subdivision 3; 16C.06; 16C.08to16C.09; and any other applicable state procurement laws and procedures.
