Sec. 10. Immediately upon filing the declaration of incorporation mentioned in section 7, 1 in the office of the secretary of state, as in that section directed, the council shall proceed to divide the newly incorporated city into wards. If such city contains a population of less than 5,000 persons, they shall divide it into 3 wards; if it contains a population of 5,000 and upwards, it may be divided into 4 wards; and a greater number of wards may be established upon the basis of population as provided in section 2, chapter 3 of this act. 2 The division shall be so made as to make the territory and population of the wards as nearly equal as may be.
