Sec. 5p. (1) Except as provided in section 5n(14) and (15), 1 a child care center, group child care home, or family child care home shall not allow an individual to be a child care staff member without requesting a criminal history check as required by section 5n.
(2) If a criminal history check performed under section 5n or information obtained as a result of notification from the department of state police under section 5k 2 reveals that a potential or current child care staff member has been convicted of a crime as described in section 5r, 3 the department shall notify the child care center, group child care home, or family child care home. The child care center, group child care home, or family child care home shall not allow the individual to be a child care staff member.
