Sec. 279. (1) Except as otherwise provided in section 281a, 281b, or 281c, 1 an individual who is brought to an approved service program or emergency medical service under section 276(1) 2 and is found by medical examination not to be incapacitated shall be immediately released and transportation may be arranged by the approved service program or emergency medical service.
(2) Except as otherwise provided in section 281a, 281b, or 281c, an individual who is brought to an approved service program or emergency medical service under section 276(5) and is found by medical examination not to be incapacitated shall be released to a peace officer representing the agency that made the arrest.
