Sec. 80130m. (1) A towing service, custodian of a vessel, or both, may recover towing fees or, subject to subsection (2), storage fees from the last titled owner or, if there is no titled owner, the last registered owner of a vessel considered abandoned under section 80130f 1 or section 80130g 2 or removed under section 80130h. 3
(2) If a vessel is released for disposition under section 80130g or section 80130k, 4 the amount of storage fees that may be collected is the least of the following:
(a) The daily storage rate established by contract or agreement with the law enforcement agency or unit of government that authorized the towing and storage of the vessel.
(b) The daily storage rate charged by the storage facility.
(c) $1,000.00.
(3) Subsection (2) does not apply to a commercial vessel or a vessel that is owned or leased by an entity other than an individual.
