In accordance with the requirements of this section, not more than once every 2 years, a licensee seeking renewal of a tier 4 cultivation facility license may apply to increase by 7,000 square feet the maximum area of plant canopy authorized under its current tier 4 cultivation facility license.
1. Approval criteria. The office may approve the requested increase if the licensee otherwise meets all applicable requirements for continued licensure under this chapter and the rules adopted pursuant to this chapter and the licensee has demonstrated to the office's satisfaction that the licensee has over the past 2-year period of licensure sold at least 85% of the adult use cannabis cultivated by the licensee at its cultivation facility.
2. Consideration of renewal of current licensed amount of plant canopy if approval criteria not met. If the office determines that the licensee has failed to satisfy the requirements of this section for the requested increase, the office shall consider renewing the license at the current tier and currently authorized maximum area of plant canopy.
