(a) This section applies to a Class 7 micro-brewery license in the county.
(b)(1) In this subsection, “protected building” means:
(i) an elementary school;
(ii) a secondary school; or
(iii) a church or other place of worship.
(2) Paragraph (3) of this subsection does not apply to a micro-brewery that was in existence on July 1, 1997.
(3)(i) A micro-brewery may not be located within 300 feet of a protected building.
(ii) The distance shall be measured from the nearest point of the building in which the micro-brewery is located to the nearest point of the property line on which the protected building is located.
(4) Notwithstanding paragraph (3) of this subsection, if a micro-brewery was established at its licensed premises before a protected building was established within 300 feet of the micro-brewery, the Executive Director may renew the license of the micro-brewery.
