A. Before reporting any violation of this Subpart to any district attorney for institution of criminal proceedings thereunder, the department shall afford appropriate notice and opportunity for hearing, in accordance with regulations prescribed by it, to interested persons upon the question of such violations. The report to the district attorney shall be accompanied by findings of the appropriate officers and employees.
B. The department need not report for prosecution minor violations of this Subpart when the purposes of the Subpart can best be accomplished by a suitable written notice or warning.
