A. The department shall promulgate in accordance with the Administrative Procedure Act all such rules as are necessary to implement the provisions of this Subpart.
B. The rules required by this Section shall include but not be limited to the following:
(1) Data elements to be included in the registry.
(2) Guidelines and procedures for obtaining from healthcare providers information regarding individuals diagnosed with sickle cell disease.
(3) Standards for ensuring that the registry is developed and operated in a manner that comports with all applicable requirements of the Health Insurance Portability and Accountability Act of 1996, P.L. 104-191; regulations adopted pursuant to that Act including but not limited to the HIPAA Privacy Rule, 45 CFR Part 164; and other applicable laws and regulations governing disclosure of health information.
