As used in this Part, the following terms have the following meanings unless the context clearly indicates otherwise:
(1) “Course provider” means an entity that offers individual courses in person or online, including but not limited to online or virtual education providers, postsecondary education institutions, including any postsecondary institution under the management of the Board of Supervisors of Community and Technical Colleges, and corporations that offer vocational or technical course work in their field, and have been authorized to provide such courses by the state board.
(2) “Eligible funded student” means any student who resides in Louisiana and meets the following criteria:
(a) Is attending a public elementary or secondary school.
(b) Has consulted with the person designated by the governing authority of the school that the student attends to enroll in a course pursuant to this Part and has written permission from a parent or legal guardian. Pursuant to R.S. 17:4002.5, the student shall not be permitted to enroll in a course that conflicts with any of the following:
(i) A determination made by the student's school counselor that the course is not to be academically appropriate considering the student's chosen major or graduation pathway.
(ii) The department's published student high school planning resources.
(3) “Eligible participating student” means any student who resides in Louisiana and meets one of the following criteria:
(a) Is a scholarship recipient as defined in R.S. 17:4013 attending a participating school in accordance with R.S. 17:4011 through 4025.
(b) Is attending a nonpublic school that is approved, provisionally approved, or probationally approved by the state board pursuant to R.S. 17:11.
(c) Is enrolled in a home study program approved by the state board.
(4) “State board” means the State Board of Elementary and Secondary Education.
