(a) Nothing in this act shall apply to actions arising out of claims for personal injury or death or where the defect or damage to the dwelling is so substantial that it is not habitable.
(b) This act shall not supersede express warranty, implied warranty or other provisions of a contract between the contractor and the claimant.
