Sec. 19.5. (a) If a Title IV-D agency collects child support payments of at least the threshold amount established under 42 U.S.C. 654(6) on behalf of an individual who has never received Title IV-A assistance, the Title IV-D agency shall collect a fee in accordance with 42 U.S.C. 654(6). The Title IV-D agency may collect the fee by issuance and implementation of an income withholding order.
(b) The Title IV-D agency shall collect the fee described in subsection (a) from one (1) of the following:
(1) Any amount of child support payments that exceeds the threshold amount established under 42 U.S.C. 654(6) and collected on behalf of the individual who applied for the services of collecting the child support payments.
(2) The parent who owes the child support obligation being enforced by the Title IV-D agency.
(3) State funds appropriated for the purpose of paying a fee under subsection (a).
