Sec. 4. (a) If a health care personnel fails, through no fault of the health care personnel, to obtain employment or the position from the health care facility to which the temporary health care services agency referred the health care personnel, the temporary health care services agency shall, upon request, refund the full amount the health care personnel paid to the temporary health care services agency for the referral. However, the health care personnel is not eligible for a refund from the temporary health care services agency if the health care personnel leaves or abandons the employment or position without reasonable cause.
(b) In addition to the payment under subsection (a), if a temporary health care services agency refers a health care personnel to a health care facility and no employment or service existed, the temporary health care services agency shall pay the health care personnel not later than five (5) days after demand, the amount of the health care personnel's transportation to and from the health care facility and other reasonable expenses.
