Indiana Code Title 16. Health § 16-46-7.5-3

Sec. 3. (a) The state department may do the following:

(1) Develop the application and the criteria and standards of eligibility for entities described in subsection (b) that apply for a grant under this chapter.

(2) Establish criteria for determining the grant amount to be awarded to an approved applicant and the terms of an awarded grant, including placing a priority on providing grants for the following:

(A) Innovative research and treatments with the potential of resulting in novel therapies for pediatric cancer.

(B) Research and treatment identified by the state department as part of the state department's needs assessment under subdivision (6)(B) to address the state's highest needs concerning pediatric cancer in Indiana children.

(3) Determine policies for the expiration and renewal of a grant.

(4) Require that all grant funds be used for the purpose of research and treatment with the purpose of combating childhood cancer.

(5) Develop procedures in ensuring that funds provided through a grant are expended for the stated purpose.

(6) Develop a written plan to assist in making determinations concerning grants under this chapter that does the following:

(A) Identifies existing pediatric cancer research, treatment, and funding programs for pediatric cancer in Indiana and those that provide assistance to children in Indiana diagnosed with cancer.

(B) Includes a needs assessment for pediatric cancer patients of Indiana identifying additional research funding needs by cancer type and geographic area, with documentation of any determination that support is needed.

(C) Includes a prioritized list of programs and research projects eligible for assistance under this chapter.

(7) Adopt administrative rules under IC 4-22-2 necessary for the administration of this chapter.

(b) The state department may only award a grant under this chapter to any of the following entities that specialize in performing research and treatment in Indiana concerning pediatric cancer for Indiana children:

(1) An Indiana institution of higher education.

(2) An Indiana academic medical center or medical research hospital.

(3) An Indiana nonprofit entity.

(4) An Indiana governmental entity.
