Indiana Code Title 12. Human Services § 12-8-1.6-7

Sec. 7. Subject to the availability of applicable waiver slots and funding, the office of the secretary shall provide access to home and community based services that are appropriate and necessary for an individual determined to be eligible by the office of the secretary for services under a home and community based services waiver.
