Sec. 3. (a) The commission shall consist of the following members:
(1) The director of the division or the director's designee.
(2) The director of the department of child services or the director's designee.
(3) The secretary of education or the secretary's designee.
(4) A representative from a community mental health provider association with statewide jurisdiction.
(5) A representative from a mental health advocacy association with statewide jurisdiction.
(6) A licensed pediatric adolescent psychiatrist.
(7) A representative of a statewide elder advisory group.
(8) A representative from the Indiana Association of County Commissioners.
(b) The president pro tempore of the senate, the minority leader of the senate, the speaker of the house of representatives, and the minority leader of the house of representatives may each appoint one (1) legislative member as a nonvoting member in an advisory role to the commission.
(c) The governor shall appoint the commission members described in subsection (a)(4) through (a)(8). The governor shall appoint one (1) member of the commission to serve as chairperson of the commission.
(d) A:
(1) chairperson shall serve at the pleasure of the governor; and
(2) commission member shall serve at the pleasure of the appointing authority who appointed the member.
If a vacancy occurs on the commission, the appointing authority that appointed the member whose position is vacant shall appoint an individual to fill the vacancy.
(e) Each member of the commission who is not a state employee is not entitled to the minimum salary per diem provided under IC 4-10-11-2.1(b). The member is, however, entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties, as provided in the state policies and procedures established by the state department of administration and approved by the budget agency.
(f) Each member of the commission who is a state employee but who is not a member of the general assembly is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties, as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
(g) Each member of the commission who is appointed under subsection (b) is not entitled to the legislative per diem for serving on the commission.
