§ 25-70. Electronic mail service; spam free. Electronic mail service providers that provide electronic mail service under State contracts awarded on or after the effective date of this amendatory Act of the 94th General Assembly must take measures reasonably designed to provide a service that is free of unsolicited electronic mail advertisements (sometimes known as “spam”). The electronic mail service provider is responsible for using software filters or other means to accomplish the requirements of this Section. In this Section, the terms “electronic mail service provider” and “unsolicited electronic mail advertisement” have the same meanings as those terms are defined in the Electronic Mail Act (815 ILCS 511/).
