Illinois Statutes Chapter 20. Executive Branch § 1705/10. Examination to determine substance use disorder

§ 10. To examine persons admitted to facilities of the Department for treatment of mental illness or developmental disability to determine if the person has a substance use disorder as defined in the Substance Use Disorder Act.  1 Based on such examination, the Department shall provide necessary medical, education and rehabilitation services, and shall arrange for further assessment and referral of such persons to appropriate treatment services for persons with substance use disorders. Referral of such persons by the Department to appropriate treatment services for persons with substance use disorders shall be made to providers who are able to accept the persons and perform a further assessment within a clinically appropriate time. This Section does not require that the Department maintain an individual in a Department facility who is otherwise eligible for discharge as provided in the Mental Health and Developmental Disabilities Code.

The Department shall not deny treatment and care to any person subject to admission to a facility under its control for treatment for a mental illness or developmental disability solely on the basis of their substance use disorders.
